Terms of Service

This software is provided by Zerocoin Electric Coin Company (“Electric Coin Co.,” “ECC,” “the company,” “licensor,” “our,” or “we”), developer of the Zashi wallet app.

Zashi utilizes industry-leading security and end-to-end encryption to ensure your personal and transaction information remain confidential. You agree to our Terms of Service (“Terms”) by using Zashi or using our websites (together, “Services”).

About our Services

Minimum age. There is no minimum age requirement to use Zashi. Users acknowledge that there may be laws in their home country that restrict usage of financial services or certain purchases based on minimum age.

Account registration. Creating a Zashi account can be completed within the app and does not require an email address, phone number, or any other personal information.

Submitting feedback. Feedback is submitted via email through the Zashi app. Users who submit feedback or request support agree to receive email responses from us.

Privacy of user data. ECC does not sell, rent, or monetize your personal data or content in any way.

Please read our Privacy Policy to understand how we safeguard the information you provide when using our Services. For the purpose of operating our Services, you agree to our data practices as described in our Privacy Policy, as well as the transfer of your encrypted information and metadata to the United States and other countries where we have or use facilities, service providers, or partners. Examples would be third-party providers sending you a verification code and processing support tickets.

Software. In order to enable new features and enhanced functionality, you consent to downloading and installing updates to our Services.

Fees and taxes. You are responsible for data and mobile carrier fees and taxes associated with the devices on which you use our Services.

Using Zashi

Our Terms and policies. You must use our Services according to our Terms and posted policies. If we disable your account for a violation of our Terms, you will not create another account without our permission.

Legal and acceptable use. You agree to use our Services only for legal, authorized, and acceptable purposes. You will not use (or assist others in using) our Services in ways that: (a) violate or infringe the rights of ECC, Zashi users, Zcash users, or others, including privacy, publicity, intellectual property, or other proprietary rights; (b) involve making illegal transactions or sending illegal or impermissible memos.

Harm to Zashi and ECC. You must not (or assist others to) access, use, modify, distribute, transfer, or exploit our Services in unauthorized manners, or in ways that harm Zashi, ECC, our Services, or systems. For example, you must not (a) gain or try to gain unauthorized access to our Services or systems; (b) disrupt the integrity or performance of our Services; (c) create accounts for our Services through unauthorized or automated means; (d) collect information about our users in any unauthorized manner; or (e) sell, rent, or charge for our Services.

Keeping your account secure. Zashi embraces privacy by design and ECC does not have the ability to access your transaction information (beyond what is available in a public block explorer) or memos. You are responsible for keeping your device and your Zashi account safe and secure. If you lose your phone, use your secret recovery phrase to restore your account on another device.

Third-party services. Our Services may allow you to access, use, or interact with third-party websites, apps, content, and other products and services. When you use third-party services, their terms and privacy policies govern your use of those services.

Availability of our services. Our Services may be interrupted, including for maintenance, upgrades, or network or equipment failures. We may discontinue some or all of our Services, including certain features and support for certain devices and platforms, at any time.

Your rights

Your rights. You own the information you submit through our Services.

ECC’s rights. We own all ECC and Zashi copyrights, trademarks, domains, logos, trade dress, trade secrets, patents, and other intellectual property rights associated with our Services. You may not use our copyrights, trademarks, domains, logos, trade dress, patents, and other intellectual property rights unless you have our written permission. To report copyright, trademark, or other intellectual property infringement, please contact [email protected].

License

This software is provided under the terms of the Consent to Use of Data clause, External Services clause, and MIT license reproduced below. It may also depend on software provided under other compatible open-source licenses.

Consent to Use of Data. ECC values your privacy and will never collect or use your personal information without your consent. You agree that Licensor may collect and use technical data and related information—including but not limited to technical information about your device, system and application software, and peripherals—that is gathered periodically to facilitate the provision of software updates, product support, and other services to you (if any) related to the Licensed Application. Licensor may use this information, as long as it is in a form that does not personally identify you, to improve its products or to provide services or technologies to you.

External Services. The Licensed Application may enable access to Licensor’s and/or third-party services and websites (collectively and individually, “External Services”). You agree to use the External Services at your sole risk. Licensor is not responsible for examining or evaluating the content or accuracy of any third-party External Services, and shall not be liable for any such third-party External Services. Data displayed by any Licensed Application or External Service, including but not limited to financial, medical and location information, is for general informational purposes only and is not guaranteed by Licensor or its agents. You agree not to use the External Services to harass, abuse, stalk, threaten or defame any person or entity, and that Licensor is not responsible for any such use. External Services may not be available in all languages or in your Home Country, and may not be appropriate or available for use in any particular location. To the extent you choose to use such External Services, you are solely responsible for compliance with any applicable laws. Licensor reserves the right to change, suspend, remove, disable or impose access restrictions or limits on any External Services at any time without notice or liability to you.

Resolving disputes and ending Terms

Resolving disputes. You agree to resolve any Claim you have with us relating to or arising out of our Terms, us, or our Services exclusively in the United States District Court for Denver, Colorado. You also agree to submit to the personal jurisdiction of such courts for the purpose of litigating all such disputes. The laws of the State of Colorado govern our Terms, as well as any disputes, whether in court or arbitration, which might arise between ECC and you, without regard to conflict of law provisions.

Ending these Terms. You may end these Terms with ECC at any time by deleting Zashi from your device and discontinuing use of our Services. We may modify, suspend, or terminate your access to or use of our Services anytime for any reason, such as if you violate the letter or spirit of our Terms or create harm, risk, or possible legal exposure for ECC. The following provisions will survive the termination of your relationship with ECC: “Licenses,” “Disclaimers,” “Limitation of Liability,” “Resolving dispute,” “Availability” and “Ending these Terms,” and “General”.

General

ECC may update the Terms from time to time. When we update our Terms, we will update the “Last Modified” date associated with the updated Terms. Your continued use of our Services confirms your acceptance of our updated Terms and supersedes any prior Terms. You will comply with all applicable export control and trade sanctions laws. Our Terms cover the entire agreement between you and ECC regarding our Services. If you do not agree with our Terms, you should stop using our Services.

If we fail to enforce any of our Terms, that does not mean we waive the right to enforce them. If any provision of the Terms is deemed unlawful, void, or unenforceable, that provision shall be deemed severable from our Terms and shall not affect the enforceability of the remaining provisions. Our Services are not intended for distribution to or use in any country where such distribution or use would violate local law or would subject us to any regulations in another country. Privacy Policy

Zashi embraces privacy by design and ECC does not have the ability to access your transaction information (beyond what is available in a public block explorer) or memos.

Information you provide

App downloads. 

Third parties. Your Zashi usage may intersect with third-party services, such as other wallets, exchanges, cellular and wifi networks, authentication apps, and others. These providers are bound by their privacy policies to safeguard that information.

Zashi account information. Creating a Zashi wallet within the app does not require an email address, phone number, or any other personal information.

Support communications. If you contact Zashi user support, any personal data you may share with us is kept only for the purposes of researching the issue and contacting you about your case.

Beta programs and testing groups. ECC facilitates user testing and feedback in third-party community apps, such as Discord. Participants agree to receive personal messages from us.

Zashi usage information

Transactions and memos. ECC cannot read, decrypt, or otherwise access your shielded transaction or shielded memo information beyond what is publicly available on a block explorer, i.e., transaction amount, time of transaction, and validation.

User behavior. ECC can see anonymized Zashi usage data, such as crash reports, error encounters, screen visits, and the aggregate number of new wallets set up.

Additional technical information. Information may be stored on our servers, including randomly generated authentication tokens and other material that is necessary for wallet functionality.

We will update this Privacy Policy as needed so that it is current, accurate, and as clear as possible. Your continued use of our Services confirms your acceptance of our updated Privacy Policy.
